USE OF THE WEBSITE…

You are provided with access to this Website in accordance with these Conditions & any orders placed by you must be placed strictly in accordance with these Conditions

You warrant that the personal information which you are required to provide when you purchase through our shop as a customer is true, accurate & complete & that you will notify us of any changes prior to delivery.

You agree fully to indemnify, defend & hold us, our directors, employees, agents & suppliers, harmless from & against all claims, liability, damages, losses, costs & expenses, arising out of any breach of the Conditions by you or any other liabilities arising out of your use of this Website, or the use by any other person accessing the Website using your personal information.

 We reserve the right to:

  • Modify or withdraw this Website (or any part thereof) with or without notice & you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website.
  • Change the Conditions from time to time, & your continued use of the Website or any part of it following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change in the Conditions then you must immediately stop using our Website.

 PURCHASE OF PRODUCTS…

We take care in so far as it is in our power to do so, to keep the details of your order secure, but in the absence of negligence on our part we cannot be held liable to any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Website.

Descriptions of Products shown on the Website include approximate measurements. Items may change as a result of improvements or modifications. Colours shown on screen are reproduced as much as electronic processes allow. We try to ensure our Website is as accurate as possible. However, we cannot be held responsible for any inaccuracies or errors which may arise.

We reserve the right to refuse or cancel any order once it has been placed. This may be done, for example if:

  • Your payment is not authorised or has been marked as fraudulent by the payment system (Stripe)
  • Payment has been made using a card not issued where the billing address is
  • There is an error on the website regarding the price or description of a product
  • We have tried contacting you about your order & have not heard back within a reasonable amount of time (Seven working days)
  • If the items you have ordered are unavailable for any reason, you will be notified as soon as possible

By placing an order with us you are confirming the information that you have given is accurate & that you are the authorised card user on which payment was made.

FORCE MAJEURE

We are not liable for any breach of agreement for delay or failure to perform if the delay or failure is due to any act of God, war, strikes, lockouts or other industrial action, difficulties in obtaining labour or parts, government or other restrictions or regulations or other event beyond the reasonable control of Optime Lighting Ltd.

REFUND POLICY

We hope you love our products, however, in the event you need to return items to us, Optime Lighting Ltd must be notified within 3 working days. Return requests can only be considered within the 3 day period. We reserve the right to refuse a refund.

We’re unable to offer a refund on bespoke goods unless they’re faulty or are damaged in transit.

DELIVERY CHARGES

An £9.50 minimum charge to cover carriage & handling will be added at checkout on all orders for deliveries within UK mainland.

RISK AND DELIVERY

Goods are delivered to the buyer when Optime Lighting Ltd makes them available to the buyer.

Optime Lighting Ltd shall not be liable to any penalty, loss, injury, damage or failure in the delivery or performance from any cause at all nor shall any such delay or failure entitle the buyer to refuse to accept and delivery of performance or to repudiate the contract.

Any dates quoted by us for delivery of the goods are approximate only and shall not form part of the contract and the buyer acknowledges that in the performance expected of the seller no regard has been paid to any quoted delivery dates.

 OUR GUARANTEE

All of our Products carry a 12 month guarantee from date of purchase.

Optime Lighting Ltd is not responsible for damages relating to natural fading or discolouration, oxidation, humidity, prolonged exposure to sunlight or salt air or other unsuitable environmental conditions. Glass, Brass & other natural materials vary in tone, colour, character & texture: variations are inherent in such materials & finishes & should be expected. **Kindly note, Glass is a natural resource & as each piece is individually handblown, slight imperfections may occasionally occur such as ripples and small bubbles.**

This Website may only be used for lawful purposes & in a lawful manner. You agree to comply with all applicable laws, statutes & regulations regarding the Website & any transactions conducted through the Website.

Under no circumstances can Optime Lighting Ltd be held liable for any direct, indirect or consequential costs, charges or expenses arising directly or indirectly as a result of late, damaged or incorrect delivery of goods. This includes, but is not limited to, electrician or any other contractor fees. You should not book an electrician on the basis of an expected delivery date & we would strongly advise you to only book your electrician when you have the lights in your possession & have checked that they are both suitable & undamaged.
